Delhi HC rules in favor of designer Rahul Mishra in design theft case — Counterfeit clothes worn by Kapil Sharma, Orry, and Badshah

In a significant ruling, the Hon’ble Delhi High Court has granted an ad-interim injunction against several parties for unauthorized copying of Rahul Mishra’s well-known “Tigress” design and floral motifs from his Sunderbans collection. The court recognized that these copies infringe on Mishra’s copyright and also impact the exclusivity of his brand.

Additionally, the order highlighted that such imitation leads to financial losses for the over 2,000 artisans working in Rahul Mishra’s ateliers across India.

Speaking after the hearing granting ad-interim injunction in favour of Rahul Mishra, he said: “This fight is about more than fabric — it’s about preserving the dignity of handcraft, protecting livelihoods, and safeguarding the creative spirit that makes Indian fashion respected worldwide.”

The infringing garments bearing the unauthorised imitations of Rahul Mishra’s handcrafted original work were found to be worn by celebrities such as Kapil Sharma on his celebrated comedy show (available on the OTT platform, Netflix), Instagram influencer Orry, and Television actor Shivam Khajuria (subsequently also found to be worn by Indian music sensation ‘Badshah’ as was seen on his social media post).


Hon’ble High Court, after comparing the original work with the copied and imitated work of the infringers/ defendants, was of the view that such products incorporating the Tigress coupled with surrounding floral motifs and embroidery patterns are identical to those created by Rahul Mishra, will cause confusion in the mind of general public as to the source of such unauthorisedly copies.

Mishra condemned the rise of a parallel fashion industry indulging in production of cheap replicas in hubs like Surat, Chandigarh, and Bangalore, amongst other places in India.

Senior Advocate Mr. Jayant Mehta, with the legal team from Khurana & Khurana Advocates, represented Rahul Mishra in the case.

As per the ad-interim injunction order passed by the Hon’ble High Court of Delhi, the infringers/ defendants have been directed to immediately cease all manufacturing, sales, and promotion of the infringing products, and to take down all related advertisements/ promotions/ listings from all platforms, online and offline and have also been asked to maintain and preserve a true account their sales done qua the infringing products bearing the Tigress and floral motifs artistic work.

The Honourable Justice Tejas Karia issued an immediate injunction prohibiting the manufacture and sale of imitations or any deceptively similar representations of Rahul Mishra’s original design. The first hearing of the case is scheduled for 19th November 2025 for the injunction issued on 4th August.
