MUMBAI: A Motor Accident Claims Tribunal awarded compensation of around Rs 1 crore, including interest, to a 34-year-old from Nalasopara who lost a leg after his outstation bus overturned near Pune in 2021. The amount will be paid jointly by the owner of the bus, M/s RN Cabs Pvt Ltd , and insurance firm United India Insurance Co Ltd .
The man, Abhijit Pujare , worked as manager for a private firm in Delhi at the time of the accident, earning a monthly salary of Rs 25,000.
"…the evidence on record goes to establish that the accident occurred due to rash and negligent driving of the offending bus by its driver and the applicant sustained injuries and permanent partial disability in that accident," the tribunal said.
Awarding the compensation, the tribunal stated, "Considering the amputation and other injuries, certainly the applicant cannot work as a manager. Thus, the functional disability of the applicant will have to be considered as 100 percent," the tribunal added.
Pujare moved the tribunal in Feb 2022, seeking compensation of Rs 1.25 crore after suffering permanent disability in a tragic road accident near Solapur highway on Jan 21, 2022. According to the application, Pujare was a passenger in a Tata motor bus, travelling towards Solapur highway in Indapur taluka of Pune district around 5.30 am. The application alleges that the driver of the bus was driving at high speed and in a rash and negligent manner, leading to the driver losing control of the vehicle. The bus subsequently dashed a roadside divider and overturned on its left side.
As a result of the accident, Pujare sustained severe injuries, including amputation of the right leg above the knee, injuries to both hands, a laceration with a tear on his left knee, a injury to his left ankle with multiple foreign bodies, a head injury with a frontal laceration, the loss of one upper tooth, and damage to three others.
At that time, he worked for a shipping firm.
