'Seems Kalyug has arrived': Allahabad HC on elderly couple's alimony battle

A case of an elderly couple aged between 75 and 80 years fighting a legal battle against each other for alimony made Allahabad High Court remark that "seems Kalyug has arrived".

A bench of Justice Saurabh Shyam Shamshery last week was hearing a petition filed by one Munish Kumar Gupta (husband) challenging a family court 's order directing him to pay Rs. 5000 as maintenance to his wife (Gayatri), Live Law reported.

The Court issued notice to the wife and scheduled the matter for a final hearing, expressing hope that the parties might reach a settlement.

The facts of the case reveal that the applicant, Munish, was an IV-class employee in the medical department. In 1981, he constructed a house in his wife's name. However, three years after his retirement, in 2008, Gayatri Devi gifted the house to their younger son, which sparked a dispute between the elderly couple, as the elder son was deprived of his rights, as per Live Law.

As a result of the dispute, the couple began living separately with their respective sons, and the wife also filed a maintenance claim against the applicant in the family court. After the family court ordered the applicant to pay Rs. 5,000 as maintenance to his wife, he approached the High Court.
